Disabled vehicle leads to DWI and drug charges for couple

(Bethlehem, NY)

On March 2, 2014, State Police stopped to check a disabled vehicle on I-87 in the Town of Bethlehem.  When Troopers approached the operator, Kathleen M. Van Auken, 25, of Troy, NY they could smell that she’d been drinking and a license check showed her to be suspended.

After failing the Standard Field Sobriety Tests, Van Auken was arrested for DWI and Aggravated Unlicensed Operation.  She provided a breath sample which revealed her blood alcohol level as .11%.  Van Auken was arraigned in the Town of Bethlehem Court and released on her own recognizance. 

During the investigation, Frank T. Bragg, 37, of Middlegrove, NY, the only other passenger, was found illegally in possession of several different types of narcotic pills outside their original container.  He was also found in possession of MDMA (ecstasy), concentrated marijuana hashish, marijuana, a hypodermic syringe, and 2 glass vials containing illegal steroids.  

Bragg was arrested and charged with the following: 

  • Seven counts of Criminal Possession of a Controlled Substance in the 7th Degree 
  • Possession of a Hypodermic Instrument, both are Class A Misdemeanors 
  • Possession of a Controlled Substance Outside Original Container, a Violation under the Public Health Law 
  •  
  • Unlawful Possession of Marijuana 
  • Bragg was released on bail and issued an Appearance Ticket directing him to appear in the Town of Bethlehem Court on March 4, 2014.
