Buffalo, NY man arrested for Felony Driving While Intoxicated, Criminal Possession of Marihuana 5th and Aggravated Unlicensed Operation 1st.

 Buffalo, NY – On July 14, 2017, at approximately 8:14 p.m., State Police responded to a report of a one car accident in the area of I-90 (near Exit 8) , in the City of Buffalo. Investigation at the scene revealed that the driver of the vehicle, David A. Rogers, age 41, of Buffalo, NY, was found to be intoxicated and in possession of approximately 40 grams of Marihuana.  Rogers was transported and processed at SP Buffalo, where he submitted to a breath test to determine the alcohol or drug content in his system, which returned a positive reading of .14% BAC. Additionally, he has two prior DWI conviction within the last 10 years and as a result was subsequently charged with:         
  • Driving While Intoxicated with two previous convictions within 10 years; a Class D Felony
  • Operating a Motor Vehicle with .08% of BAC or more with 2 prior Convictions within 10 years; a Class D Felony
  • Criminal Possession of Marihuana 5th Degree; Class B Misdemeanor.  
  • Aggravated Unlicensed Operation 1st Degree; Class E Felony                   
  • Multiple Vehicle and Traffic Violations.
Rogers was transported to City of Buffalo Court holding facility awaiting arraignment in the City of Buffalo Court on July 17, 2017, at unknown time.
