On September 21, 2017, at approximately 3:40 PM, State Police at Manhattan stopped a vehicle for improper display of license plate and illegal window tinting  on the Bruckner Expressway at Rosedale Avenue in the Bronx.

Probable cause searches of the vehicle and five occupants were conducted, and one passenger, Kevin Nivar, 24, of Bronx, NY, was found in possession of oxycodone pills.

Subsequent to being arrested and placed in handcuffs, Nivar intentionally jumped over the concrete barrier and fell approximately 20 feet landing onto the shoulder of Bruckner Boulevard.  Nivar was transported to Jacobi Medical Center where he remains in critical but stable condition.

Nivar was charged with Criminal Possession of a Controlled Substance in the 5th degree and will be processed upon his release.

In addition, Nivar, the driver, Jose Madera, 33, of Bronx, NY, and passenger Xavier Santana, 27 of Bronx, NY, were also charged with Criminal Possession of a Firearm, after an inventory of the vehicle by the New York City Police Department resulted in the discovery of a loaded semi-automatic handgun in the engine compartment of the vehicle.

Madera was also issued traffic tickets.

The New York State Police and the New York City Police Department are continuing investigation in conjunction with the Bronx District Attorney’s Office.
