Pair arrested for possessing over 4 pounds of Cocaine and 2 loaded handguns subsequent to a traffic stop

 Schodack, NY– On January 31, 2018, at approximately 9:37 p.m., State Police stopped a vehicle on I-90, in the town of Schodack for a vehicle and traffic violation. During the interview of the driver for the vehicle and traffic violation probable cause to search the vehicle and its occupants was established. The driver of the vehicle, Juan Rodriguez, age 37, of Syracuse, NY and his passenger Allens R. Batista Rivera, age 37, of Buffalo, NY were found to be in possession of over 4 pounds Cocaine and 2 loaded illegally possessed handguns. They were taken into custody, transported, and processed at SP Albany. They were subsequently charged with:
 
  • Criminal Possession of a Controlled Substance in the 1st degree; a Class A Felony
  • Criminal Possession of a Controlled Substance in the 3rd degree; a Class B Felony (Narcotic Drug with intent to sell)
  • Criminal Possession of a Weapon 2nd degree (Loaded Firearm) a Class C Felony (2 counts)
  • Criminal Possession of Controlled Substance 5th degree; a Class D Felony
  • Criminal Possession of a Weapon 3rd degree; a Class D Felony
  • Criminal Possession of Stolen Property 4th degree; a Class E Felony (firearm)     
  • Vehicle and Traffic Violations (Rodriguez only)
 
 
Both men were transported and arraigned in the Town of Schodack Court and remanded to the Rensselaer County Jail with no bail. Return court date of February 6, 2018, at 5:00 p.m. has been set in the Town of Schodack Court.
