Tractor Trailer Operator Charged with Aggravated DWI

On Monday, April 2, 2018, the New York State Police based in Fonda, in conjunction with the Troop G Commercial Vehicle Enforcement Unit (CVEU), arrested 55 year old Timothy Hemphill of Pueblo, Colorado for Aggravated DWI following a traffic stop.
At approximately noon on Monday, a member of CVEU was observing commercial traffic in the Village of Fultonville. The Trooper observed a tractor trailer being operated without a Highway Use Tax sticker. A traffic stop was initiated in the vicinity of Exit 28 on the NYS Thruway (I-90). During the interview with the operator, the Trooper observed the odor of alcoholic beverage emanating from the tractor trailer operator. The operator was identified as Timothy Hemphill. Mr. Hemphill stated that he had consumed two 40 oz. beers the previous night. He submitted to Standardized Field Sobriety Tests, subsequently failing them. He also gave a positive sample on the Pre-Breath Test Screening device.
Mr. Hemphill was placed under arrest for suspicion of operating a commercial motor vehicle while in an intoxicated condition and was transported to the SP Fonda barracks for processing. While at SP Fonda, Mr. Hemphill submitted to a breath test which yielded a 0.18% BAC. He was charged with "E-Felony" Aggravated DWI--Commerical Vehicle and was arraigned in the Town of Amsterdam Court. He was remanded to Montgomery County Jail in lieu of bail, pending a future court date.
