Johnstown Man Charged With DWI

At approximately 7:00 p.m. on Monday, June 4th, 2018, the New York State Police based in Fonda received a report of a possible intoxicated male at Cumberland Farms in the Village of Fonda. 

As the Trooper arrived at the gas station, he observed Mr. Hayner exit Cumberland Farms and walk toward his vehicle which was parked at the gas pumps.  The Trooper observed Mr. Hayner to have difficulty walking and noted the odor of alcoholic beverage coming off of him.  During conversation with the Trooper, Mr. Hayner admitted to driving his vehicle to Cumberland Farms and to consuming alcoholic beverages prior to driving.  He was asked to take Standardized Field Sobriety Tests which he subsequently failed.  He also submitted to a Pre-Breath Test screening which yielded a positive result for the presence of alcohol.

Upon being taken into custody for the suspicion of DWI, he was searched and several items containing marijuana were located.  He was transported back to the State Police barracks at Fonda where he submitted to a breath test which yielded a 0.17% BAC.  He was charged with misdemeanor level DWI and Unlawful Possession of Marijuana.  He was issued appearance tickets returnable to the Town of Mohawk Court at a later date, and was released to a sober third party.
