State Police assist with traffic stop in Burke which leads to arrest

On October 27, 2018, at approximately 11:52 p.m. State Police received a call from U.S. Border Patrol requesting assistance with a traffic stop on State Route 11 in the town of Burke.
Border Patrol agents conducted a traffic stop on a 2005 Scion for being uninspected. The operator, 35-year-old Elijah A. Phelps of Morrisville, Vermont, had a suspended and expired license in Vermont and his driving privileges were also suspended in New York. The vehicle was found to be unregistered, uninsured, uninspected and had switched plates. A rifle was located in the rear of the vehicle as well as approximately 19 grams of marihuana, and a scale containing marihuana residue. A criminal history check revealed Phelps was convicted in Vermont on multiple felonies. Phelps was arrested for Criminal Possession of a Weapon 4th degree and Unlawful Possession of Marihuana. He was further ticketed for aggravated unlicensed operation 3rd degree, unlicensed operation, uninsured motor vehicle, unregistered motor vehicle, switched plates, and uninspected motor vehicle. Phleps was arraigned in the Town of Malone Court and remanded to the Franklin County Jail in lieu of $5,000 cash bail or $10,000 bond. Phelps is scheduled to reappear in the Town of Burke Court at a later date.
