Albany man resists during arrest for DWAI Drugs and drug possession on the Thruway.

Bethlehem, NY – On July 7, 2019, at approximately 1:37 a.m., State Police located a vehicle which appeared to be disabled on the shoulder of I-87 in the town of Bethlehem.  Troopers discovered the driver asleep at the wheel.  A welfare check was conducted on the driver, Peter M. Foster, 58, of Albany, NY, who was found to be impaired by drugs and in possession of .3 grams of crack-cocaine and a pipe containing crack cocaine.  While being taken into custody, Foster resisted arrest.  He was ultimately secured and transported to SP Albany where he refused to submit to a chemical test or blood draw to determine the drug content in his system. 
 
Foster was charged with Driving While Ability Impaired by Drugs; an Unclassified Misdemeanor, Criminal Possession of a Controlled Substance 7th degree; a Class A Misdemeanor, Obstructing Governmental Administration 2nd degree; a Class A Misdemeanor, Resisting Arrest; a Class A Misdemeanor, and a vehicle and traffic violation. 
 
Foster was arraigned before the Town of Bethlehem Court and was released under the supervision of the Department of Probation.  He is scheduled to reappear on August 6, 2019 at 4:00 p.m.
