On 5-22-2020, Troopers arrested Joshua R. Lemk, 22, of Gowanda, NY, for Driving While Intoxicated, False Personation, Obstructing Governmental Administration 2nd Degree, Aggravated Unlicensed Operation 1st Degree (Felony)

 

Troopers conducted a traffic stop of a red SUV on Maple St in the Village of South Dayton. During the investigation of the stop, a strong odor of alcohol was detected while interviewing Lemk. Initially, Lemk provided the Troopers with a false name, but Troopers were able to discovered Lemk’s real name. A DMV report revealed that Lemk had a suspended license and an active warrant out of the Cattaraugus County Sheriff’s Office. Troopers administered Standardized Field Sobriety Tests on Lemk, who subsequently failed them and was taken into custody. Lemk provided a breath sample of .14% BAC. Lemk was issued Appearance Tickets for Driving While Intoxicated, False Personation, Obstructing Governmental Administration 2nd Degree, Aggravated Unlicensed Operation 1st Degree (Felony), and other associated VTL infractions. Lemk was later turned over to the Cattaraugus County Sheriff’s Office. Lemk is scheduled to appear in South Dayton Village Court in June.
