On December 14, 2019, at approximately 10:30 p.m., State Police conducted a traffic stop on Cold Spring Road in the town of Ausable Ford on a 2004 Ford F150 for having no license plates, and for failure to signal it’s turn into the driveway of 163 Cold Spring Road.
The operator, 45-year-old John J. Smith Jr., of Peru was subsequently arrested for DWI. A 14-year-old child was in the vehicle at the time of the stop. Smith’s blood alcohol content was determined to be 0.10%. He was also found in possession of more than 2 ounces of marijuana and a quantity of suboxone pills and dextroamphetamine pills, neither of which Smith possessed a prescription for.
Smith was ultimately charged with Felony DWI under Leandra’s Law. He was arraigned in the Town of Peru Court and remanded to Clinton County Jail without bail due to having two previous felony convictions.  Smith is to reappear in the Town of Ausable Court at a later date and time.
