On September 4, 2022, at approximately 7:10 p.m., a state trooper from the Montgomery barracks observed a 2005 Chevrolet Silverado traveling on State Route 9W in the city of Newburgh in violation of the New York State Vehicle and Traffic Law. The trooper stopped the vehicle and identified the operator as Marco Martinez Pinzon, age 35 from Passaic, New Jersey. While speaking to the operator, the trooper learned that Martinez-Pinzon was unlicensed and was impaired by alcohol. The trooper observed there to be 11 occupants in a vehicle that only seats 6 people. One of the occupants was a four-year-old minor. Martinez-Pinzon had a blood alcohol content (BAC) of .17% and was charged with Felony DWI Leandra’s Law and Endangering the Welfare of a Child, a misdemeanor. He was released on an appearance ticket returnable to the City of Newburgh Court on October 12, 2022, at 9 a.m.
