PRESS RELEASE
 
On September 13, 2020, at 6:40 a.m., State Police responded to Meigsville Road in the town of Elizabethtown for an injured man.  An investigation revealed that a 48-year-old male who had been hiking around New York from out of state, accepted a ride from 37-year-old Sean R. Gallagher of Westport, and 26-year-old Alan R. Smith of Plattsburgh. Gallagher and Smith then assaulted the man by striking him in the face and head with their fists and the end of a shotgun. The victim sustained multiple bruises and lacerations to his head and face, including a broken orbital bone, and he was taken by ambulance to Elizabethtown Community Hospital.
 
Gallagher was charged with Assault 2nd degree, Criminal Possession of a Weapon 3rd degree, Tampering with Physical Evidence, Criminal Mischief 3rd degree, Menacing 2nd degree, and NYS Public Health Law Violation of Unlawfully Growing Cannabis. He was arraigned in the Chesterfield Town Court and remanded to the Essex County Jail, on $5,000 bond.
 
Smith was charged with Tampering with Physical Evidence, Criminal Mischief 3rd degree, and Assault 3rd degree. He was arraigned in the Westport Town Court and released on his own recognizance to reappear in Elizabethtown Court at a later date.
