On Sunday, May 1, 2022, at approximately 11:25 am, a Trooper attempted to stop a Nissan Altima for speeding on the Northern State Parkway in the area of New Highway, in the town of Smithtown, Suffolk County, but the driver failed to comply. After a brief pursuit, the Nissan entered the on-ramp to the Sunken Meadow Parkway, but the driver failed to negotiate the curve and crashed into the wood line. The driver then fled on foot.

Both Gordon and Simmons were charged with Criminal Possession of a Weapon 2nd degree, a C-Felony and Criminal Possession of a Weapon 3rd degree, a D-Felony and were held for arraignment on May 2, 2022, at Suffolk County 1st District Court.
