On February 13, 2020, at approximately 10 a.m. State Police responded to a report of animal cruelty reported by a Franklin County offical and occuring in the town of Burke.

An investigation with the Franklin County Animal Cruelty Task Force led to the arrest of 67-year-old Jack P. Spinner of Malone, and 76-year-old Linda L. Paquin of Burke, when a pony that was in their care was not able to walk due to its hoofs being overgrown and curling. Following an examination by a veterinarian, the pony had to be euthanized due to its condition.

On March 11, 2020, Spinner and Paquin were both charged with one count each of Animal Cruelty under the New York State Agriculture and Markets Law. They were released with appearance tickets returnable in the Burke Town Court.
